General Terms and Conditions of sale (GTC)

1. Scope

These General Terms and Conditions of Sale (GTC) govern all sales of printed photographs and any products or services offered on the website vandiguemoulin.com (hereinafter: "the Website") by its owner (hereinafter: "the Artist"), residing in Valais, Switzerland.

The Artist acts as a private individual and is not registered in the commercial register nor subject to VAT.

Any order placed on the Website implies unreserved acceptance of these GTC.

2. Products and services

The products offered for sale are limited edition printed photographs.

Each photograph:

  • is numbered,
  • is accompanied by a statement of authenticity signed by the Artist,
  • and may present slight variations compared to the images displayed on the Website (particularly due to screen settings or the printing process).

The services offered include:

  • art rental,
  • photography rental,
  • other artistic works.

The Artist reserves theright to modify the product and service offerings at any time.

3. Prices

Prices are listed:

  • in Swiss francs (CHF) for Switzerland,
  • in euros (EUR) for other European countries.

Prices are net, excluding VAT (as the Artist is not subject to VAT under Swiss law).

Delivery costs areincluded in the sale price, both for Switzerland and for other European countries.

For deliveries outside Switzerland:

  • customs clearance fees,
  • local VAT,
  • and any customs duties may be levied by the authorities of the destination country.

These costs are entirely the responsibility of the customer.

4. Order

The order is confirmed when payment is accepted via the Stripe payment platform.

The Artist reserves the right to refuse or cancel any order in the event of:

  • an existing dispute with the client,
  • suspicion of fraud,
  • incomplete or incorrect information.

In the event of refusal or cancellation of an order by the Artist, a full refund will be issued to the client.

5. Payment

Payment is made exclusively online via Stripe, by credit card or any other method offered by the platform.  Transactions are secure. These terms and conditions are separate and do not form part of these General Terms and Conditions.

6. Delivery

6.1 General Information

The indicated delivery times include both the production time of the artwork and the shipping time.

6.2 Delivery in Switzerland

Deliveries are made by Swiss Post as parcels, with insurance and signature required upon delivery.

The estimated delivery time is 5 to 10 business days from order confirmation.

6.3 Delivery in Europe

Deliveries are made by Swiss Post to the following countries (continental Europe):

Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Monaco, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.

The estimated delivery time is 7 to 15 business days.

Shipments are not insured.

The customer is informed that:

  • shipments may be subject to customs clearance,
  • additional charges (local VAT, customs duties, processing fees) may be levied upon delivery.

These charges are the sole responsibility of the customer.

6.4 Liability

For deliveries with in Switzerland:
as shipments are insured by Swiss Post, any claims must be submitted in accordance with their terms and conditions.

For deliveries withinEurope:
as no insurance is taken out, the Artist accepts no liability for loss or damage during transport.

In all cases, the risks associated with transport are transferred to the customer upon delivery of the package to the carrier.

7. Right of withdrawal and refund

No right of withdrawal or refund applies to purchases made on the Site.

8. Intellectual property

The purchase of a photograph does not entail any transfer of copyright.

The Artist retains all intellectual property rights to their works.

The customer acquires only a physical ownership right to the print.

Any reproduction, distribution or commercial use of the image is strictly prohibited without the Artist's prior written authorization.

9. Ownership of the original artwork

The prints sold are numbered original reproductions.

The original artwork (electronic source file and painting) remains the exclusive property of the Artist.

10. Statement of authenticity

Each photograph is accompanied by a statement of authenticity signed by the Artist, attesting to:

  • the originality of the work,
  • its number within the series,
  • its authenticity.

11. Invoicing

An invoice is issued for each order.

It does not include VAT,in accordance with the Artist's status (not subject to VAT).

For deliveries in Switzerland:  the invoice is sent electronically to the email address provided by the client.

For deliveries in Europe: the invoice is included with the shipment to facilitate customs clearance.

The Artist's official name and address appear only on the invoice.

12. Data Protection

The personal datacollected during the ordering process is used exclusively for:

  • order processing,
  • customer relationship management,
  • compliance with legal obligations.

Data may be transmitted to third-party service providers (particularly for payment and delivery) as part of order fulfillment.

These providers have their own personal data processing policies. The Artist cannot be heldliable for the data processing carried out by these third parties. Personal data used in a sales transaction cannot be deleted, in accordance with legal retention obligations.

13. Liability

The Artist shall not be held liable for:

  • delays attributable to the carrier,
  • customs duties or local taxes,
  • damage or loss incurred during transport,
  • third-party service providers and their processing of personal data.

In any event, the Artist's liability is limited to the amount actually paid by the customer forthe order in question.  Any liability for indirect damages, such as loss of profits, loss of opportunity, or intangible damages is expressly excluded.

14. Applicable law and jurisdiction

These Terms and Conditions are governed by Swiss law.  

In the event of a dispute, the place of jurisdiction is Valais, Switzerland.

16. Force majeure

The Artist shall not beheld liable for the non-performance or delay in the performance of its obligations in the event of force majeure.

Force majeure includes, but is not limited to: natural disasters, fires, pandemics, strikes, interruptions of postal services, failure of communication networks, or any other event beyond the Artist's reasonable control.

In such a case, the Artist's obligations are suspended for the entire duration of the event.

17. Electronic Evidence

The data recorded on the Website, as well as that recorded by the payment systems (including Stripe), constitutes valid proof of transactions concluded with the customer.

Order confirmations, emails, and electronic records are considered valid evidence between the parties, unless proven otherwise.

18. Partial Invalidity

If any provision of these Terms and Conditions is declared invalid or unenforceable, the other provisions shall remain in full force and effect.

The provision in question shall be replaced by a valid provision that most closely approximates the original intent.
